Einhorn Lawyers Win Precedent-Setting Case in Appellate Division

On January 29, 2021, Einhorn Barbarito attorneys Christine M. McCarthy, Matheu D. Nunn and Christopher L. Musmanno secured a precedent-setting appellate victory for a client who was gravely injured after being struck by a snowplow truck owned by the Township of Sparta. The decision, Lapsley v. Twp. of Sparta, ___ N.J. Super. ___ (App. Div. 2021) (Docket No. A-0958-19T3), argued by personal injury partner Christine McCarthy and briefed by co-chair of the firm’s general Appellate Practice Matheu Nunn and chair of the firm’s Personal Injury practice Chris Musmanno, reversed a trial court decision that deemed the victim’s injuries as compensable through worker’s compensation and therefore non-compensable in the Law Division, Civil Part. As a result of the Appellate Division’s decision in favor of the client, the victim of the accident is now able to pursue appropriate damages within the Law Division before a jury.
